A chair can find the motion not to be in order, a decision which the membership can overturn.

But if the chair recognized the motion is and the seconded it would not be proper at that point for the chair to unilaterally decide that the motion can not be voted on. Of course any member could raise a point, which the chair would decide if well taken or note. And that to could be overriden by the membership.

No. The rest of your post was correct. The chair should, once the motion is made, rule that the motion is out of order as it conflicts with the constitution or bylaws. If there is a (even remotely) plausible argument that it isn't (and not just a member wishing to pass a motion that is obviously in violation of the bylaws), then an Appeal can be made of the chair's ruling, and the decision on the Appeal governs.
