rthib Posted November 6, 2012 at 10:11 PM Report Share Posted November 6, 2012 at 10:11 PM Not sure what you mean by something wrong in the by-laws.If it is procedural, then probably not.If something is in violation of the bylaws, Say the bylaws require the President to be 18 and they are 17, then you could raise the issue. Guest Robert Paust Posted November 6, 2012 at 10:26 PM Report Share Posted November 6, 2012 at 10:26 PM the board said in the minutes that a new member could not be elected to the board without being a member for 1 year. There is nothing in the by-laws that say´s that
jstackpo Posted November 6, 2012 at 10:52 PM Report Share Posted November 6, 2012 at 10:52 PM Please be a tad more specific. What was "wrong"? (We won't tell!)
Guest Edgar Posted November 6, 2012 at 10:55 PM Report Share Posted November 6, 2012 at 10:55 PM the board said in the minutes that a new member could not be elected to the board without being a member for 1 year. There is nothing in the by-laws that say´s thatWell, what the board says doesn't belong in the minutes in the first place, just what the board does. In any case, what's recorded in approved minutes is never changed. Just be on your toes the next time someone is elected to office and "the board" says he's not eligible. That's the time to raise a point of order.
jstackpo Posted November 6, 2012 at 11:05 PM Report Share Posted November 6, 2012 at 11:05 PM Ah, I asked before seeing you response....In effect "the board" -- more likely some individual member of the board -- made a point of order that was incorrect. But since no appeal from the (subsequent) ruling (that the point was "well taken") was made at the time it is too late to do anything about it now.Just don't do it again... and tell the person (nicely, of course) that he was in error.See RONR p. 247 ff. for details about points of order and appeals. rthib Posted November 6, 2012 at 11:29 PM Report Share Posted November 6, 2012 at 11:29 PM I am assuming he was nominated and his nomination was denied for that reason.Time to raise the issue was when the ruling was made. There is no continuing bylaws violation, so nothing can be done now.If it was the other way (bylaws said you must be a member for 1 year to be an officer and he was not) You could raise a point since there would still be a violation.
