Guest Mitch - CRYC Posted November 21, 2012 at 03:37 PM Report Share Posted November 21, 2012 at 03:37 PM Our Constitution and Bylaws specifically states and discribes the job, duties and responsibilities for each elected officer position; a job description if you will.Membership presented an argument that Roberts Rules allows membership to overturn an officers decision regardless if the club constitution and bylaws provides such authority. Question is; can membership vote to overturn an officers decision that is within that officers authority as described within a clubs constitution and bylaw? g40 Posted November 21, 2012 at 03:53 PM Report Share Posted November 21, 2012 at 03:53 PM Robert's Rules does not override the organization's Constitution and Bylaws if such documents explicitly prohibit membership overriding such officer's decision or if such documents place sole authority for such decisions with such officers. If so, the membership does not have the power to reverse it. If not, then it can.
Rev Ed Posted November 21, 2012 at 04:18 PM Report Share Posted November 21, 2012 at 04:18 PM Even the Board as a whole may or may not have exclusive authority/power over issues - again only the By-laws and Constitution will say that. And remember, Chapter XX (or the organization's own By-laws) allow for a trial to punish an officer. Thus the membership could always remove an officer if he/she does not do their job in the way the membership wishes.
