Guest Sherrie Coulter Posted September 29, 2017 at 01:18 PM Report Share Posted September 29, 2017 at 01:18 PM We recently had a vote in our Fiscal Court meeting that resulted in 3 yes votes 2 no votes and 1 abstention. The Judge said vote failed, but we believe it should have passed. Where can we find documentation to back this up?
Dan Honemann Posted September 29, 2017 at 01:34 PM Report Share Posted September 29, 2017 at 01:34 PM If you have no rule requiring something other than a majority vote, the motion was adopted. Documentation is found in RONR, 11th ed., on page 400.
Richard Brown Posted September 29, 2017 at 01:45 PM Report Share Posted September 29, 2017 at 01:45 PM Guest Sherrie, if you don't have a copy if RONR, you might look at FAQs 4 and 6 on the main website. Here is a link to FAQ 4. FAQ 6 is two questions further down: http://www.robertsrules.com/faq.html#
J. J. Posted September 29, 2017 at 02:09 PM Report Share Posted September 29, 2017 at 02:09 PM Since this sounds like a government body, I would advise you to consult with your solicitor to see if there is a statute requiring a different standard. For example, a statute may require that there be a majority of the entire membership. I don't think either of the previous posters will object.
