Guest abc Posted July 24, 2019 at 01:37 PM Report Share Posted July 24, 2019 at 01:37 PM In a small booster club setting where the bylaws do not address this situation what is the right/legal thing to do: The board unknowingly allowed 2 non members vote in an election for officers. Their votes had a direct impact on the outcome of said election. Obviously the members of the club need to be aware of the situation but what is our next step? Joshua Katz Posted July 24, 2019 at 01:49 PM Report Share Posted July 24, 2019 at 01:49 PM Raise a point of order at the next meeting. If you expect it will be controversial, know who will appeal and who will second, and potentially who will speak on the appeal and what they will say. Or, in short, have allies. Guest abc Posted July 24, 2019 at 01:50 PM Report Share Posted July 24, 2019 at 01:50 PM Does the outcome of the vote stand or should/must we have a re-vote?
Joshua Katz Posted July 24, 2019 at 01:51 PM Report Share Posted July 24, 2019 at 01:51 PM If, as you say, the illegal votes changed the outcome of the election (that is, are within the margin of victory) then the result of a point of order will be to invalidate the election and conduct a new one. Atul Kapur Posted July 24, 2019 at 04:48 PM Report Share Posted July 24, 2019 at 04:48 PM (edited) 3 hours ago, Joshua Katz said: If, as you say, the illegal votes had the potential to change changed the outcome of the election (that is, are within the margin of victory) Mr. Katz, I took the liberty of editing what you had said. I believe the standard is that the illegal votes could have changed the election. It would be a much tougher thing to prove that the illegal votes actually changed the election.
