Removal of a Duly Elected Senator

We have a duly elected (by their department) Senator who is actually part time faculty and part time Director of Academic Enrichment (honors).  At our last Senate meeting we voted on an issue that had a split vote (9-3), but in a Senate meeting with a quorum the issue was decided.  However, as the "Director" he is also on the Academic Council where he brought up the issue AGAIN despite the "issue begin settled."  Our Executive committee has met and decided this is a clear conflict of interest, and want to remove him from the Senate, however, our Constitution and Bylaws do not have any provisions that address removing a Senator.  What can we do?  We DO have procedures from replacing an officer, but NOT a Senator.  While we plan to write in language that will not allow ANYONE on the academic council to sit on both Senate and Council, we feel something needs to be done immediately.

Ultimately I think it will depend on a thorough examination of any applicable laws and a close reading of your Bylaws and Constitution which is something you will probably need to hire a local parliamentarian and/or lawyer to do.  In short, it may be as simple as voting to remove him from office or as complicated as having to hold a full-fledged trial to remove him or it may be totally out of the sphere of RONR or any other parliamentary procedure.

What exactly do the bylaws say concerning the senators’ term of office?
