Use of email

The club I belong to used email to send out a message about a proposed bylaw change. The email was sent to board members, and a former board member who is no longer on the board. This message asked for feedback about the proposed change. One of the board members responded, but sent the email to the entire membership. The board is proposing discipline because they claim it is a violation of executive session, since the proposal was talked about at a board meeting, with the penalty of expulsion from the club. This action would be by the board only, and not through a vote of the club as specified in the bylaws. This does not seem fair, as email is not very secure. Also, the fact that they sent out the original email to a non board member seems to negate their charges!

This brings up two questions.

1. What action can the board take, if any?

2. Can they expel this person from the club, or only from the board?

Any response would be appreciated. Thank You!

Since the offense was committed outside a board meeting, I very much doubt the board has any power to try, convict, and punish the accused. You'll need to check the bylaws to make sure, though. If the board wishes, it can make a report to the general membership assembly, which will take it from there.
