mcfarland Posted November 11, 2015 at 06:50 PM Report Share Posted November 11, 2015 at 06:50 PM Please assist. Scenario: A membership organization, where members pay dues to belong. A vote was taken on a motion at our meeting on November 9. The motion failed to be adopted and the vote was 7 to 7. This morning, a member has argued that one of the members voting had not paid their dues, and therefore the vote is nullified and the motion was adopted. Is this correct? If not - can the vote be reconsidered? If so, when? Please advise.

Unless your rules say otherwise, the vote stands: "A member of a society who is in arrears in payment of his dues, but who has not been formally dropped from the membership rolls and is not under a disciplinary suspension, retains the full rights of a voting member and is entitled to vote except as the bylaws may otherwise provide." George Mervosh Posted November 11, 2015 at 07:13 PM Report Share Posted November 11, 2015 at 07:13 PM Okay, so now answer the second question. Grrrrrrrrrrr, you hung around you know who too much these past several years. No, the vote on the motion cannot be reconsidered at your next meeting, since your next meeting is almost certainly a new session. The motion can be made again by any member if they so choose, perhaps if they see one of the guys who voted no the first time is home watching Law & Order. Gary Novosielski Posted November 13, 2015 at 02:33 PM Report Share Posted November 13, 2015 at 02:33 PM Okay, so now answer the second question. The second question began "If not...", and so was effectively never asked.

Yes, it was asked since the answer to the first question was "no".
