  2. Lol! I am back now. Yes that is what our Bylaws say. I copied and pasted them as written. I can not speak on how long they have been this way. The amendments used to be the same as well, 1/3. They were changed about 3 years ago to 2/3.

  6. Would you be able to share the RONR reference? Also this is what the bylaws say about suspension. Does this change anything? Would the notice fall under business procedure? No Bylaws shall be changed except by a vote of one-third of the members voting, a quorum being present. Bylaws relating to business procedure, transaction of business, rules of order and other standing rules not requiring a ballot vote may be suspended
  7. Hello, I am seeking some guidance regarding suspension of bylaws. Our HOA says special meeting can be held with 4 days notice. An emergency come up and the president wants to have the special meeting without the 4 days notice. He said that we can meet, suspend the bylaws and have the meeting. Is this accurate? Can the bylaws be suspended? If not, is there a way to still have this meeting without violating the bylaws? Thank you!

  10. Hello, Is zoom polling permissable as secret ballot? Our bylaws say secret ballot and conforms to RONR. I understand that a report can be pulled in zoom and you can see how people voted which to me is no longer secret. Is this accurate?

  12. Thank you for the response! I should have been more specific as I was trying to understand if the bylaws had to explicitly say hybrid or does electronic meetings cover the topic of hybrid. There are no organizers, that's why I asked. This is the direction of the president with no further information.
  13. I am seeking some clarity and guidance on hybrid meeting as this is recent debate in our HOA. Our bylaws say this about electronic meetings...Electronic Meetings may be conducted by telephone or other electronic means, “that permit simultaneous aural communication” when physical meetings are impractical. The president said that we will have hybrid meetings starting next month. We are also having elections in July. My first question is does this language in the bylaws allow hybrid meetings? There is no plan for cameras and some of the other devices that I understand are needed to ensure an in person experience for those who choose to remain virtual. If this is in order, how might the voting be conducted in a hybrid setting? Thank you!

  17. I do have a copy of RONR and in brief. The confusion for me is unrelated to RONR. You stated that what the president stated can be done and then offered a way to do it which was different than what I stated. I was trying to understand based on what I stated if that was in order but I understand now based on Mr. Kapur's response that you were offering a solution for how it can be done.
  18. Thank you for your response although I don't fully understand it. What you are saying isn't how the information is being proposed or presented. There isn't any intent to to create a bylaws committee. The intent as mentioned is to vote on the structural change and then make changes to the Bylaws over the summer. I wanted to verify if that was in order to do.
  19. Hello, I am in an organization that is going through a restructure. In our last meeting, the changes were presented to be voted on next month. Part of the changes is eliminating positions that are in the bylaws. The president said that the proposal to restructure will be voted on first and then over the summer the Bylaws will be updated. Is that the correct steps to take? I thought any proposed changes that would affect the bylaws would have to be presented as a proposed bylaw amendment and voted on first. Also we don't meet over the summer. Please advise. Thank you!
  20. Hello I am seeking guidance on a couple questions related to Elections. Our bylaws just say that elections are done by secret ballot. We have 4 positions where there are 3 nominees for each office and 1 position where there is 1 nominee for 1 office. Here are my questions: 1) Is there a special rule that can voted on for the nominee with the least amount of votes to drop? 2) Are there are options for the candidate that is running unopposed to be declared the nominee elected even though the Bylaws say elections are done by secret ballot?
  21. The poll only showed yes and no. No other options to vote either. It was a vote on a motion. So where does the more than half apply? I didn't understand that to be 50% but more than 50%.
  22. It was shown as percentage. I'm not familiar with the polling to answer if numbers are an option.
