Guest James Posted April 26, 2012 at 10:40 PM Report Share Posted April 26, 2012 at 10:40 PM Hi I have a quick question. We have a member who is on probation for not making merit points per our by-laws. He was until January a member in good standing. We offer a reserve membership in our organization which strips them of voting rights and length of service. The only rule in our by-laws to move to reserve membership is that it is approved by the chair. Is there a rule that states a member "on probation" may not change their membership status or our we bound by the by-laws and chair's decision? Please let me know if anyone has a similar circumstance. J. J. Posted April 26, 2012 at 10:49 PM Report Share Posted April 26, 2012 at 10:49 PM RONR has absolutely nothing on probation. You will have to look at your own rules.
Chris Harrison Posted April 26, 2012 at 10:50 PM Report Share Posted April 26, 2012 at 10:50 PM As far as RONR is concerned you are either a member with all of the rights of a member or you aren't a member. If you all have more than one class of membership it will be up to you all to work out the details (though any limitations on the rights of the member must be spelled out in the bylaws). Guest James Posted April 26, 2012 at 10:58 PM Report Share Posted April 26, 2012 at 10:58 PM I was afraid of that. I think our rules do not spell out the request to change membership status so the I would believe the chair's decision would have to stand. Thanks for the quick reply. Guest Edgar Posted April 26, 2012 at 11:17 PM Report Share Posted April 26, 2012 at 11:17 PM . . . I would believe the chair's decision would have to stand.Well, not exactly. If you (and enough other members) think the chair got it wrong (and not simply that you wish it were otherwise), you can appeal his decision. Guest James Posted April 26, 2012 at 11:23 PM Report Share Posted April 26, 2012 at 11:23 PM I think a few members do not agree but not enough to appeal the decision. I am just afraid it may start a precedent of members on probation just wanting to change their membership status to reserve instead of being removed form the org for failure to make merit as per our by-laws. Rev Ed Posted April 26, 2012 at 11:48 PM Report Share Posted April 26, 2012 at 11:48 PM Depending on the situation, you might want to amend the By-laws to either change how the members may change their membership (i.e. either on request or by a vote of a group - the Board, the general membership, or a Committee for example) or to change how members can remain at a specific level.
