Guest Rita Posted May 16, 2012 at 03:34 PM Report Share Posted May 16, 2012 at 03:34 PM We record all of our minutes from the Board meetings and then the Secretary makes the minutes from it. Can any Board member request a copy of the tape of those minutes before the Secretary erases them? Thanks.
Gary Novosielski Posted May 16, 2012 at 03:38 PM Report Share Posted May 16, 2012 at 03:38 PM Probably not, unless you've passed some special rule about that. A recording used to assist the secretary in the preparation of the minutes is just a recording, it is not the minutes. And depending on the situation, it may even be the personal property of the secretary, for all we know.
jstackpo Posted May 16, 2012 at 03:42 PM Report Share Posted May 16, 2012 at 03:42 PM I suppose so, but it would be far better if the Board member asked the assembly (Board) for permission (majority vote) to listen, and gave his/her reasons why. The Secretary is within his rights to say "No" to the individual Board member. The recording is NOT the official minutes, as you realize. David A Foulkes Posted May 16, 2012 at 03:42 PM Report Share Posted May 16, 2012 at 03:42 PM We record all of our minutes from the Board meetings and then the Secretary makes the minutes from it. Can any Board member request a copy of the tape of those minutes before the Secretary erases them? Thanks. Not to brazenly dispute Mr. Novosielski for no good reason, but I think the answer to Guest_Rita's actual question is two-fold: 1) Sure, any Board member can request a copy of the tape (and the Secretary can just say no), and 2) RONR does not speak to this issue. Of course, if Rose Mary Woods is the Secretary, it's probably a moot point anyway by now.
Rev Ed Posted May 16, 2012 at 05:34 PM Report Share Posted May 16, 2012 at 05:34 PM Of course, the assembly could restrict the rights of any member with regards to recording the meeting. As such, the Board could pass a special rule requiring the Secretary to keep the recordings for a specific timeframe and to make them avaialble "upon reasonable notice" while specifying that the members cannot abuse the right.
