Guest nancy smith Posted June 11, 2012 at 09:24 PM Report Share Posted June 11, 2012 at 09:24 PM I live in a co-op in Memphis, TN--I am being sued by the BOD's for dog poo-poo, 2 lawn chairs, grill on the grounds (the co-op means that we all have the right to enjoy the lawn/property because no one owns any of the land) and other crazy stuff. The President charged me with several violations of the rules/regs but guess what--we do not have any rules/regs--so when my lawyer ask for the documentations prior to the meeting he refused to give and then said the BOD's have decided to buy me out--well, we have both spent 10,000 thus far and the Judge has required mediation. Not sure what we will mediate--I corrected all issues and signed Occupancy Agreement and now they say the OA is not a legal doc and does not mean that they will let me stay.. The meeting is Sat and the announcement said that the President would address why/how we have a lawsuit. Does the BOD's think that I would not come to defend myself and not come with legal coverage.Feedback welcomed--Thanks
Chris Harrison Posted June 11, 2012 at 09:37 PM Report Share Posted June 11, 2012 at 09:37 PM I am sure we all sympathize but do you have a question about Robert's Rules of Order which is what this forum deals with?
jstackpo Posted June 11, 2012 at 09:38 PM Report Share Posted June 11, 2012 at 09:38 PM RONR doesn't deal with dog poop or any of the other legal and local rule questions you raise. So no feedback from this quarter.
Rev Ed Posted June 11, 2012 at 09:39 PM Report Share Posted June 11, 2012 at 09:39 PM This is outside the scope of RONR as it deals with legal issues and mediation. Sorry, but we cannot help you here.
Trina Posted June 13, 2012 at 11:50 AM Report Share Posted June 13, 2012 at 11:50 AM The title of the thread is 'Annual Meeting and taking lawyer' -- perhaps there is an implied question as to whether a member is allowed to bring a lawyer to a meeting? Ms. Smith?
jstackpo Posted June 13, 2012 at 11:58 AM Report Share Posted June 13, 2012 at 11:58 AM If the "meeting" in question is an RONR-style trial, then, yes, Nancy S. has the right to be "represented by council" - p. 664.But whether the co-op is following RONR procedures is another, unanswered, question.(BTW, I (mis)read the thread title as "talking lawyer" which seemed more likely...)
