Guest m dickinson Posted July 11, 2012 at 12:36 AM Report Share Posted July 11, 2012 at 12:36 AM We have a rule that all children must leave the club by 6pm. Recently we had a nineteen year old with his mother should he have left at the 6pm time or allowed to stay? Other children have been asked to leave at 6. Who makes the decision of how old they should be, we were told that he was old enough to go and stay in a bar, but we are a private club, and the bar tender on duty was asked about it, she didn't know what the rule was. David A Foulkes Posted July 11, 2012 at 12:42 AM Report Share Posted July 11, 2012 at 12:42 AM Who makes the decision of how old they should be[?]Your membership, in drafting and approving your rules. RONR says nothing on the subject. Your rules should distinguish at what age this restriction no longer applies. I'm willing to wager a small sum that all your members are children, assuming they all have (or had) parents.

Chris Harrison Posted July 11, 2012 at 12:45 AM Report Share Posted July 11, 2012 at 12:45 AM I wouldn't necessary consider a 19 year old to be a "child" but it is ultimately up to you all to determine up to what age someone is considered a child. Then that determination should be codified in the rule to eliminate such questions in the future.
Rev Ed Posted July 11, 2012 at 01:28 AM Report Share Posted July 11, 2012 at 01:28 AM I would not consider a 19-year-old to be a child. However, what does the rule actually state, and is there a rule as to what a "child" is in the organization? If there is nothing, then I'd go with a 19-year-old being an adult and suggest the organization amend the appropriate By-laws/rules to clarify the issue. sMargaret Posted July 11, 2012 at 02:30 PM Report Share Posted July 11, 2012 at 02:30 PM A reasonable person would probably assume that the legal age of majority in your area is when a person ceases to be considered a child - something to consider when checking your bylaws. If your bar tender is not sure when the age of majority is, you may have other issues with your establishment.
