Guest Don Smith Posted October 30, 2012 at 01:59 PM Report Share Posted October 30, 2012 at 01:59 PM If a school board member is appointed during a meeting can he vote later in the meeting after he is approved?
jstackpo Posted October 30, 2012 at 02:06 PM Report Share Posted October 30, 2012 at 02:06 PM Presuming the appointment is proper (by the rules of the Board), and the appointed person then immediately becomes a member of the Board, then Yes he can vote as any member can. Guest Don Smith Posted October 30, 2012 at 02:17 PM Report Share Posted October 30, 2012 at 02:17 PM If the school's bylaws say that the board has to begin a new search for a replacement member and they didn't follow that procedure what can be done to check the validity of the process? jstackpo Posted October 30, 2012 at 03:05 PM Report Share Posted October 30, 2012 at 03:05 PM Vote "No" on the motion to appoint him.Or raise a point of order when the appointment motion is presented. If it now a done deal, check with your Board attorney. RONR tells you that it is too late to raise objections. The law might say otherwise.
JohnR Posted October 30, 2012 at 04:41 PM Report Share Posted October 30, 2012 at 04:41 PM RONR tells you that it is too late to raise objections. The procedure to search for a replacement is not a rule of order. My opinion is that a continuing breach exists and the appointment is null and void.

Don said it was, to be sure, but reading the exact words in the bylaws may be critical. No! Don't post them here -- we're not in the bylaw interpretation business here.
