SptbgLawyer Posted August 19, 2013 at 04:43 PM Report Share Posted August 19, 2013 at 04:43 PM We have a Council that meets monthly. We have an ordinance on which Council has discussed postponing action on. The desire, however, is to postpone action until a meeting which is the third month after their present meeting (or until their November meeting - they plan to make this motion at the August meeting). The hope is to have action on the ordinance after a possible planning session. Can the motion be to postpone to the November meeting or should the motion be to postpone until after a planning session (presently not scheduled or confirmed). They do not want to kill the ordinance. Any guidance and suggestions appreciated.

Josh Martin Posted August 19, 2013 at 04:57 PM Report Share Posted August 19, 2013 at 04:57 PM Can the motion be to postpone to the November meeting or should the motion be to postpone until after a planning session (presently not scheduled or confirmed). So far as RONR is concerned, neither motion is in order. A motion cannot be postponed beyond the next regular session. So the best the council could do would be to postpone the motion to the September meeting. It would be in order to postpone the motion again at that time, and the council could keep doing this until it gets postponed to the November meeting (or further, if need be). Since this is a city council, however, it's entirely possible that the council's rules or applicable law have bearing on this subject, and such rules would supersede RONR. J. J. Posted August 19, 2013 at 06:35 PM Report Share Posted August 19, 2013 at 06:35 PM Assuming that you have no specific rules on the subject, the ordinance may be referred to a committee, with instructions to report back by the November meeting. I do agree that the motion may not be postponed. [added the "no"]

J. J., should this read "Assuming that you do not have specific rules on the subject"?
