If they are recording and the membership does not tell them they cannot record or to stop recording is the recording legal
Edgar Guest Posted April 13, 2015 at 09:59 PM Report Share Posted April 13, 2015 at 09:59 PM The assembly (the members present) decides what can and can't be done at a meeting (subject to any applicable rules or laws, of course). Nothing in RONR authorizes a member to record a meeting. Nothing in RONR prohibits a member from recording a meeting. Questions about the legality of a recording should be addressed to an attorney. Transpower Posted April 13, 2015 at 10:43 PM Report Share Posted April 13, 2015 at 10:43 PM RONR (11th ed.), p. 471, ll. 26-28: "The use by the secretary of a recording device can be of great benefit in preparing the minutes, but a transcription from it should never be used as the minutes themselves." Edgar Guest Posted April 13, 2015 at 10:48 PM Report Share Posted April 13, 2015 at 10:48 PM RONR (11th ed.), p. 471, ll. 26-28: "The use by the secretary of a recording device can be of great benefit in preparing the minutes, but a transcription from it should never be used as the minutes themselves." In this instance I suspect the person making the recording isn't the secretary. And, in any event, the secretary can't record the meeting unless the organization says she can (or doesn't say she can't).
