Our by laws do not state when board members actually come on the board, our election is in October, (voting).just before our board meeting. Do the newly elected come on board at that time or wait till the next meeting in November?

Also our by laws have nothing in them about if only 3 members go off and only 2 sign up to be on the board, do we just accept them to fill the vacancy or actually vote them in?

This second question I need to elaborate on this, to fill the board we need 3 members to complete the board, only 2 have signed up to fill the vacancy ( what I am asking is do we have to have a formal vote for these 2?)  Also can one (1) of the members going off the board be nominated before the voting to come back on the board?  Our by laws state board members an be reelected.

You are getting into dangerous territory if you let people simply sign up to be on the board. If your bylaws specify that your board shall consist of a certain number of members, that is the number you should have. If your by laws require an election by ballot, that provision cannot be waived and you must conduct an election by ballot. If your bylaws do not require a ballot vote, the election can be held by voice or, if you have the exact number of nominees as there are positions to fill, they can be accepted by acclamation.

Depending only language in your bylaws, you can probably have a nominating committee to try to come up with additional nominees. You can also take nominations from the floor. Finally, there can also be write-in candidates. In any event, you must do what the bylaws require when it comes to electing board members.
