riwheeler Posted November 14, 2016 at 07:52 PM Report Share Posted November 14, 2016 at 07:52 PM I was elected to a position with my HOA. The president's first comment to me , as a Director, was disturbing to me ! I was told that verbal contact with a HOA Management Company individual would cause me to be Censured ? As an owner I have had many casual and owner conversations with this person. Can I be censured by the president of the association, without due course ? What would constitute Censure by Due Course ? Hieu H. Huynh Posted November 14, 2016 at 08:15 PM Report Share Posted November 14, 2016 at 08:15 PM The president only has such powers that the bylaws provide. Your rules could have details regarding censure.

Ask your president for the source of such a rule, since your rule isn't a parliamentary rule, and didn't come from Robert's Rules of Order. Gary Novosielski Posted November 16, 2016 at 03:49 AM Report Share Posted November 16, 2016 at 03:49 AM Also find out what he thinks the effect of Censure would be. According to RONR, censure can only be done by a majority vote of the body imposing censure, and the effect of censure is to let the person being censured know that the body doesn't like what he did. There is no other discipline imposed. Censure is essentially a slap on the wrist, if you ignore the fact that they can't actually slap your wrist.
