Annual Budget & Approval

A- The Budget Committee of our Unit Owners Association recently completed our new budget and forwarded it to the Board of Directors for consideration and acceptance. It was considered and "Adopted" by majority vote, then was presented by the Board at the Annual Meeting for the "Approval Action" of the Unit Owners Association (A Condominium Community). The 'Association' voted to approve, and did so. That vote was unanimous.

Question One:- Do you agree that the procedure outlined was proper?

Question Two:- Insofar as the vote of the Unit Owners (Association) is concerned, was a simple majority vote to adopt the Budget adequate, or, should we have had a verified 2/3 vote?

B- Regarding 'Motions to Amend Something Previously Approved', isn't a 2/3 vote of the Unit Owners always required?

Answer One - The procedure was proper if it was completely in accord with your rules on budget approval.

Answer Two - Unless your rules require a greater threshold, a majority vote would be sufficient according to RONR.

Answer B - No, not according to RONR. The motion to Amend Something Previously Adopted requires a 2/3 vote without previous notice, a majority vote with previous notice, or a vote of a majority of the entire membership.

Unexpected question!

A budget is YEARLY, typically.

So any vote on a NEW budget won't fall into the category of "Amend Something Previously Adopted."

Whatever budget would have been presented this month is probably the 2017 budget.

You would not be amending your 2016 budget.

So I am thrown by the question about the vote threshold for "A.S.P.A." motions.

Q. Are you just tweaking a few categories of your 2016-2017 budget? Or is the budget wholly new for the year?
