Guest Jacin Hightower Posted September 22, 2017 at 02:48 PM Report Share Posted September 22, 2017 at 02:48 PM If a vote (with a specific effective date) has been passed but was never implemented, can that same vote (with a changed effective date) be used to implement at a later date. Or, does that vote need to be raised again? Ex: a vote was passed to terminate an employee effective April 1, 2017; however, the chair and another member decided to forego implementation of that termination. Now, several months later the chair wants to use that same vote (updating the effective date to October 1, 2017) to move forward with the termination. Is that allowable or should another motion, and vote need to be made?

It was improper for him to decide to forego implementation of the motion in the first place.
SaintCad Posted September 23, 2017 at 04:33 PM Report Share Posted September 23, 2017 at 04:33 PM Seems like there is more going on here. Why did the Chair refuse to do their duty before and now why do they want to do it? As for the motion itself, you could always Amend Something Previously Passed just to keep it unquestionable. Or it could discipline the chair for not executing the motion.
SaintCad Posted September 24, 2017 at 03:07 AM Report Share Posted September 24, 2017 at 03:07 AM Then I guess the question is: what is the status of an motion that invokes a deadline for its implementation if the action is never carried out. Does the motion "expire"?

Does the motion "expire"? It remains valid. Motions do not expire. If the assembly no longer wishes for the motion to be carried out, the motion should be rescinded. J. J. Posted September 24, 2017 at 03:42 PM Report Share Posted September 24, 2017 at 03:42 PM I will point out that implementing a motion may take a long time.
