SusanKCloutier Posted August 23, 2018 at 12:31 AM Report Share Posted August 23, 2018 at 12:31 AM Our chapter, of a National organization, wishes to adopt a bylaw which is not included in either National or State Bylaws. It does not in any way go against any bylaw but is what many of our members would like to have happen. Are we precluded from making such a bylaw because it does not exist on the higher levels of our organization?
Guest Who's Coming to Dinner Posted August 23, 2018 at 12:40 AM Report Share Posted August 23, 2018 at 12:40 AM No, unless the rules of the superior organizations prohibit you from making your own rules or exercise exclusive authority over the subject area your proposed bylaw addresses. Benjamin Geiger Posted August 23, 2018 at 12:41 AM Report Share Posted August 23, 2018 at 12:41 AM Unless it contradicts Federal or state law or the bylaws of your national or state organization, your organization should be able to enact bylaws as you see fit. (Why would local organizations have bylaws if they could only restate their parent organizations' bylaws?)

Chris Harrison Posted August 23, 2018 at 12:53 AM Report Share Posted August 23, 2018 at 12:53 AM Agreeing with my colleagues I would strongly suggest if there is any doubt as to whether these amendments may cause a problem with the folks higher up that you contact the State and/or Federal organization to run it by them. Better ask now and adjust the amendment to address any concerns they have than possibly have them send it back later because what you all believed to not be problematic turns out to be a problem.
