Nominated for ex bd ??? Conflict

We are getting ready to annouce nominations for our 2011-2012 exec. bd ~ there are nominees that were on ex bd last yr (2009-2010) that spend money that was not on original fiscal year budget / nor disclosed throughout their term / or bank account disclosed. THe money and acct were closed at end of their term, the money was used within the buildings for upgrades, however general members were not made aware or given the opportunity to vote or discuss on the matter. Is this a conflict of interest to put on nomination ballot or even allow them to run or be elected for exec. offices (ie: any seat but esp. President & Treasurer)

However, their conduct in office can (and perhaps should) be considered by the assembly when deciding whether to re-elect them. Note that, unless you have an opposition candidate, they WILL be elected.

Likely, yes, but not necessarily a lock. If voting is by ballot vote, enough write-in candidates could sway the election. Hopefully the membership has been educated as to the imcumbents' behavior and will take steps to prevent their re-election.

Were they tried and found guilty of these actions? If they were, than surely the membership would remember. If not, then who kept them from being aware, and how come you know about it if they don't? If they weren't found guilty, what makes you think they are? None of this makes any difference in the answer, I'm just curious.

The answer is that they can run for office unless there is some rule that makes them ineligible. And that rule would have to be a customized one in your organization, because it is not anywhere in RONR. The rules there say that if someone would make a bad treasurer (or other officer), the way to prevent that from happening is to elect someone else.

I am a current board member ~ and when they handed over the paperwork they had a new line item on the budget of "future capital projects" that was not on the original budget presented in September - and there was never any notion throughout their term made to the public that there was a significant amount of money sitting that could have been used on various technology items instead of what it was used on ~ as well as we got paperwork from the bank about the closed account start amount and then end amount ~ we've never wanted to open the "can of worms" but it has become apparent that things were handled wrong within their board ~ we've thought about it ~ but don't want the drama (we're talking about a PTO just FYI) ~ and the current board is up for re-election as we are a board that is up every year for re-election ~ the nomination forms that have come in is very clear that it is the same person(s) writing their names multiple times ~ as well as a few other new nominee's I just want to make sure the nomination committee is not blind sided
