Whether he's a member (of the council) or not. And if he is a member of the council, he might be able to resign as president but retain his seat on the council. But, if your bylaws provide that a resignation is effective when received, then his resignation is already effective and there is nothing to accept.... unless you want to go through the motions just for the heck of it. You will have to check your bylaws for such a provision on resignations. And while you are at it, check the provisions for filling vacancies. That should be in your bylaws, too.
