Bookish Posted September 24, 2015 at 10:43 PM Report Share Posted September 24, 2015 at 10:43 PM At an HOA meeting a motion was made to renew a man’s contract and the vote was defeated. Is the vote’s result of not renewing his contract adopted by the assembly or are only approved motions adopted by the assembly?
Edgar Guest Posted September 24, 2015 at 11:08 PM Report Share Posted September 24, 2015 at 11:08 PM At an HOA meeting a motion was made to renew a man’s contract and the vote was defeated. Is the vote’s result of not renewing his contract adopted by the assembly or are only approved motions adopted by the assembly? Only adopted motions are adopted. The contract was not renewed, There's usually no need to "approve" a motion (though a motion could be ruled out of order). In either case, whether the assembly adopts or defeats a motion, the assembly has made a decision.

Bookish Posted September 24, 2015 at 11:48 PM Author Report Share Posted September 24, 2015 at 11:48 PM The contract calls for "HOA and contractor agree to give written notice of 60 days via registered mail if either party’s intent is not to renew or renegotiate this contract" This 60 days notice was sent to the contractor after the vote. How long can a defeated motion be brought up?
Edgar Guest Posted September 24, 2015 at 11:51 PM Report Share Posted September 24, 2015 at 11:51 PM How long can a defeated motion be brought up? There's no time limit on how long a defeated motion can be Renewed (made again as if it had never been made before). But contracts are more likely to be a legal, rather than a parliamentary, issue.
