Guest janbrooke Posted December 1, 2011 at 03:04 PM Report Share Posted December 1, 2011 at 03:04 PM At a recent Board of Governor's meeting - with a set agenda, the President addition a motion that was not on the agenda and wished for a vote. Is this legal. Can motion be added to an already accepted agenda during a meeting?

Guest Edgar Posted December 1, 2011 at 03:16 PM Report Share Posted December 1, 2011 at 03:16 PM Can motion be added to an already accepted agenda during a meeting?Sure. But not unilaterally by any one member (not even the president).
Chris Harrison Posted December 1, 2011 at 03:36 PM Report Share Posted December 1, 2011 at 03:36 PM Sure. But not unilaterally by any one member (not even the president). That depends on if the agenda has a place for New Business and the motion the President wants introduced falls within New Business. Even if it does there might still be FAQ #1 implications.
Guest Guest Posted December 1, 2011 at 03:37 PM Report Share Posted December 1, 2011 at 03:37 PM OK - the President brought up the motion and presented it to the Board. One member stated that this was not legal. The President said so long as the Board accepted the motion to be placed on the agenda- it was ok. The he requested a vote on this new motion. ??????? The he requested a vote on this new motion. ???????First, he should have requested a vote to Amend Something Previously Adopted (the agenda) or at least tested for unanimous consent. He's right that so long as the Board agrees (by the requisite 2/3 or majority of the entire board) it is okay. But was it okay?
Guest Edgar Posted December 1, 2011 at 04:03 PM Report Share Posted December 1, 2011 at 04:03 PM That depends on if the agenda has a place for New Business and the motion the President wants introduced falls within New Business.Making a motion during the "New Business" portion of the Agenda adds nothing to the Agenda. This was brought up under new business and it did pass as it was something everyone wanted. It was a just a concern that I had if this was legal. It was a just a concern that I had if this was legal.Well, it appears to have been properly passed, at least. Whether it was legal or not depends on what it said. That is, if everyone voted to go hold up a liquor store, that would not be legal, even if properly adopted under New Business.
