At this month's Board meeting,the Board called to order,allowed the 10 minute open comments from residents, then immediately voted to adjourn the meeting and go to executive session. Nothing was said about reconvening the general Board meeting. Approximately 100 residents were in attendance. After an hour, the Board reappeared and attempted to re-convene the general open Board meeting. The few residents in attendance dissented loudly that this meeting was now out of order because they had not stated they would be re-convening thus no proper notice was given so that people could attend. Timothy Posted July 24, 2015 at 11:49 AM Report Share Posted July 24, 2015 at 11:49 AM As far as RONR is concerned, executive session can either be all of a meeting or just a portion of the meeting. This appears to be a case where only a portion of the meeting was held in executive session. You might consider whether the requirement for notice is for the meeting or for something else. If it is for the meeting, I see no reason to think the board did anything improper, because it is the same meeting they started before going into executive session. What the board should have done was call a brief recess so the non-members could leave before the board went into executive session. When it adjourned the meeting, the meeting was over. When it adjourned the meeting, the meeting was over.Given that the board voted to "adjourn the meeting and go to executive session," it seems quite clear to me that the board meeting was continuing in executive session.
