Guest Hollie Posted June 12, 2018 at 12:50 AM Report Share Posted June 12, 2018 at 12:50 AM Can a board that voted and the motion failed, go back into executive session, come out and vote again?
Hieu H. Huynh Posted June 12, 2018 at 01:23 AM Report Share Posted June 12, 2018 at 01:23 AM Generally the same motion cannot be renewed at the same meeting, regardless of whether the meeting was in executive session.
Hieu H. Huynh Posted June 12, 2018 at 01:30 AM Report Share Posted June 12, 2018 at 01:30 AM An exception would be if a motion to reconsider was adopted. Your other thread suggests that this may be the case.
Richard Brown Posted June 12, 2018 at 01:38 AM Report Share Posted June 12, 2018 at 01:38 AM I haven't seen the other thread, but I was going to suggest that although a main motion cannot be introduced again at the same meeting, it could probably be reconsidered which permits it to be voted on again. Gary Novosielski Posted June 13, 2018 at 06:22 PM Report Share Posted June 13, 2018 at 06:22 PM (edited) If this is at the same meeting (session) where the first vote was taken, a member who voted on the prevailing side can move to Reconsider the motion, which (if seconded) would bring it back before the assembly as it was prior to the original vote. At that point it could be debated further, amended, postponed, or the original decision could be reversed, or upheld. See RONR 11th ed. §37. But if, as is likely, the meeting is now over, refer to the other answers above. Keep this rule in mind if it happens again.
