Can a newly elected person be required to resign before being interviewed for a separate appointed position. This person fully intends to resign if appointed to the new position, but will serve out her elected position if turned down for the appointed one.

The default rule in RONR is that someone can serve in more than one office at a time (RONR p. 440 ll. 14-17) and if the organization wants to limit someone to one office at a time and/or require the person resign from their current office before running for the other they would need to amend their bylaws to say so.

And it seems a bit foolish to me as well - if the membership didn't want this person involved to begin with he/she would never have been elected to an office. By making the person resign to try and get another position means that you might end up without the person being involved at all. That's assuming this not what the organization has now decided.

Only if you have rues in your bylaws that say this must be done--and I'm betting you don't.

There's certainly no nutty rule like that in RONR.

IF your bylaws prohibit someone from serving in two offices, then yes, they would have to resign at some point, but not before the interview.

Ask yourself, if you were going for an interview for a new job, would you quit your present job before you went for the interview, or do you think it might be wiser to wait for an actual job offer?
