Guest Guest Posted October 30, 2014 at 02:03 PM Report Share Posted October 30, 2014 at 02:03 PM A vote to override an exisitng bylaw will be requested at our general membership meeting asking membership to vote in favor of giving a single member additional dock footage to fit their new larger boat. The bylaw in question states that if a members boat no longer fits their dock, they must bid on a dock that does. My question is, can a vote be held to override an exisiting bylaw? Thank you. Edgar Guest Posted October 30, 2014 at 02:13 PM Report Share Posted October 30, 2014 at 02:13 PM . . . can a vote be held to override an existing bylaw? Not that bylaw.
Hieu H. Huynh Posted October 30, 2014 at 02:18 PM Report Share Posted October 30, 2014 at 02:18 PM My question is, can a vote be held to override an exisiting bylaw? Such action taken that conflicts with the bylaws is null and void. Your group may choose to amend your bylaws, following the steps provided in your bylaws for amending them. Richard Brown Posted October 30, 2014 at 02:33 PM Report Share Posted October 30, 2014 at 02:33 PM It can't be done even with a unanimous vote.

Honemann, Lages, and Dr. Entropy all understand about getting larger boats and are going to be sad to read the correct responses here.

Sounds like you don't need to amend the By-laws at all. You don't need to 'override' them, not that you can do that anyway. The member just has to bid on a larger dock, plan and simple.
